Effective cargo security in the food processing industry requires keeping track of all your outbound shipments from the shipping dock to the receiving dock. A visual inspection of your tractor-trailers and tankers (empty and loaded) should confirm the following:
  • Are all major points of entry and discharge sealed?
  • Are seals numbered and recorded on the wash ticket/bill of lading?

Hazardous Materials Transportation
 

Hazardous materials are defined by the Secretary of  Transportation as those materials and substances that are capable of posing an unreasonable risk to health, safety and property when transported in commerce.

Hazardous materials are an integral part of daily life:

  • gasoline to power our vehicles,

  • fertilizers and pesticides to maintain beautiful, insect-free lawns,

  • paints and varnishes to keep our homes looking new,

  • chlorine to maintain that beautiful blue clean water in our backyard swimming pool.

More than three billion tons of hazardous materials are transported annually in the United States – on airplanes, trucks, railroads and vessels.

That means more than 800,000 hazardous materials shipments every day – 365 days a year. Most of these materials reach their destinations safely. But incidents do occur and hazardous materials are released. They can damage property and the environment – or worse, cause injuries and casualties.

The U.S. Department of Transportation is responsible for developing, issuing and enforcing the Hazardous Materials Regulations.

The Hazardous Materials Regulations are in Title 49, Code of Federal Regulations, Parts 171-180. If you are involved in the transportation of hazardous materials, you should have a current copy of 49 CFR Parts 100 through 185.

The Hazardous Materials Regulations govern the transportation of hazardous materials in all modes of transportation.

They set forth standards for classification, packaging, hazard communication, emergency response information, training of hazmat employees, transportation and incident reporting. The regulations also state that packaging and containers for shipping hazardous materials must be prepared as required. It is a serious violation to represent packages or containers as meeting U.S. DOT requirements when they do not.

 

Violations of the Hazardous Materials Regulations may result in criminal penalties of $500,000 and five years in jail. Civil penalties range up to $27,500.

Training RequirementsGo to the top of this page
 
Federal DOT regulations require training (and retraining) of all employees who perform work functions covered by the Hazardous Materials Regulation (HMR; 49 CFR 172.7000). Any employee who works in a shipping, receiving or material handling area or who may be involved in preparing or transporting hazardous materials is required to have this training. This includes not only airbag modules and batteries, but also hazardous waste such as waste paint and used parts cleaner solvent. If you sign the documents, you are the shipper. It is the employer's responsibility to fully comply with the training requirements. Failure to train employees may result in civil and / or criminal penalties of up to $27,500 per violation
  • general awareness/familiarization,
  • function-specific, including driver training for
    hazmat employees who operate motor vehicles;
